Terms of Service

1. Acceptance of Terms

By creating an account or using any part of the Unipply platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Service. These Terms constitute a binding agreement between you and Unipply, governed by the laws of the Republic of South Africa.

2. Eligibility

• Students: You must be at least 13 years old to register. If you are under 18, your parent or legal guardian must consent to these Terms on your behalf.
• Teachers: You must be at least 18 years old and hold a valid SACE registration number. By applying as a teacher, you confirm that your SACE number is valid and that you are legally permitted to teach in South Africa.
• School Administrators: You must be authorised by your institution to register on behalf of the school.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate, current, and complete information during registration.
• You must notify us immediately at support@unipply.co.za if you suspect unauthorised access to your account.
• You may not share your account with another person or create multiple accounts.

4. Description of Service

Unipply provides:

• A free APS calculator and programme discovery tool for South African NSC students.
• Academic record management and personalised roadmap tools.
• A marketplace for connecting students with registered SA teachers and tutors.
• School administration tools for curriculum tracking and student management.
• An application tracker to monitor university application statuses.

We do not guarantee admission to any university programme. APS calculations and programme eligibility information are provided for guidance only. Always verify requirements directly with the institution.

5. Payments and Subscriptions

• Payments are processed by PayFast, a South African payment gateway. By making a payment you also agree to PayFast's terms of service.
• Course fees and subscription prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable.
• Subscription fees are billed monthly or annually in advance and are non-refundable except where required by the Consumer Protection Act 68 of 2008.
• You may cancel a subscription at any time; access continues until the end of the paid period.

6. Teacher Terms

• All teacher applications are reviewed and approved by Unipply. We reserve the right to reject or revoke teacher status at our discretion.
• Teachers receive 90% of course revenue; Unipply retains 10% as a platform fee.
• Earnings are tracked in a teacher wallet. Payout terms will be communicated when the payout feature becomes available.
• Teachers must not share CAPS examination papers, memoranda, or any material in violation of the Department of Basic Education's copyright.
• Teachers are independent contractors and not employees of Unipply.

7. Content Policy

You must not upload, post, or share content that:

• Violates South African law, including the Cybercrimes Act 19 of 2020.
• Is false, misleading, defamatory, or fraudulent.
• Infringes the intellectual property rights of any person or organisation.
• Contains examinations, memoranda, or assessment materials obtained illegally.
• Harasses, bullies, or discriminates against any person.
• Contains malware, spam, or unauthorised advertising.

We reserve the right to remove any content that violates this policy and to suspend or terminate accounts responsible for violations.

8. Application Tracker

The Application Tracker is a beta feature. By providing your university portal credentials you authorise Unipply to access those portals on your behalf solely to retrieve your application status. You remain solely responsible for all activity on those portals. Unipply does not guarantee the accuracy of status information retrieved from third-party portals.

9. Intellectual Property

The Unipply platform, branding, and all original content created by Unipply are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

Content you upload (e.g. academic records, course materials) remains your property. By uploading content you grant Unipply a limited, non-exclusive licence to store and display it solely for the purpose of providing the Service to you.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that programme eligibility information will always be current. APS calculations are based on the information you provide and the publicly available NSC grading system.

11. Limitation of Liability

To the maximum extent permitted by South African law, Unipply shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to reliance on APS calculations or programme recommendations. Our total liability to you in any calendar year shall not exceed the total fees you paid to Unipply in that year, or R500, whichever is greater.

12. Termination

You may delete your account at any time via Settings → Delete Account. We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your personal information will be handled in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before significant changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
